Due to popular demand, LSM is pleased to offer this all new one day course for mediators. The course may be done before or after the mediation course.
Whilst it is not essential for a mediator to be a lawyer, an understanding of legal principles and the legal system is certainly an advantage in many mediations. A mediator with an understanding of the legal system, timeframes, and tests can ably reality test a participant's case.
On the course we will cover:
The English and Welsh legal system - Courts and Tribunals
The lifecycle of a claim
An overview of Civil Procedure Rules
The role of Solicitors, Barristers and Judges - the
How a judge will "find" a case
The standard and burden of proof
Negligence/breach of duty
Causation and damages
Expert witness evidence
Lay witness evidence
Methods of funding litigation
Legal costs and disbursements
Sanctions for refusal to mediate (and failure to respond to an invitation to mediate)
Legal definitions and "jargon"
This is a classroom taught course. The course will be led by either a senior qualified Solicitor or Barrister and is recommended for all non-lawyer mediators.
